The Derby select board took the Derby Line trustees by surprised by not accepting the changes the trustees wanted in their village. The Derby select board declined to approve a bylaw amendment that would remove “Auto Service Station/Mini Mart” as a conditional use in the village commercial zoning district, and prohibit commercial establishments from having drive-through windows in the commercial area.
Brian Smith, chairman of the Derby select board, said Thursday that he favors the bylaw amendment, but is concerned about legal action.
