DERBY - The Village of Derby Center is appealing Judge Howard VanBenthuysen decision in a recent law suit. The Village of Derby Center billed Newport for water that was allocated or reserved for the city, not the actual amount used. The matter went before the courts and the judge ruled in favor of Newport. The city said that being billed for the allocation was in violation of the 1997 contract with the village. The village Clerk Betsy Bumps said that VanBenthuysen’s decision was “not proper,” and that his decision was contrary to a different judge’s decision on the same issue.
